SALES TERMS & CONDITIONS

1. Delivery


Delivery periods stated by Studio Joachim-Morineau are for information purposes and may not be regarded as being of the essence, unless otherwise expressly agreed in writing.

The risk in the products to be delivered will pass to the Buyer the moment the products leave Studio Joachim-Morineau storage space, irrespective of the agreements made between Studio Joachim-Morineau and the Buyer regarding carriage and insurance.

 



1.1 Change of circumstances and force majeure


If after the conclusion of an agreement the prices of raw materials, wages, import duties, taxes or other external costs increase (whether or not as a result of exchange rate fluctuations), Studio Joachim-Morineau will have the right to adjust its sales price to that increase. Studio Joachim-Morineau must inform the Buyer of such a circumstance as soon as possible, after which the Buyer will have the right to dissolve the agreement within a period of eight days.


If Studio Joachim-Morineau is unable to perform the agreement due to an event of force majeure, it will have the right to dissolve the agreement in full or in part or to suspend its obligations until the event of force majeure has ended. The Buyer will in that case be obligated to pay for any products already delivered.

 

 

2. Return Policy


Please contact studiojoachimmorineau.com at online-shop@studiojoachimmorineau.com before returning any items.


You can return the product within 14 days of delivery. The product must be in new condition. If the product is ruined or used the product shall not be refunded. Make sure to include contact information with the return and if possible, please provide us with a tracking number and a brief description of your case.


studiojoachimmorineau.com suggests you get a receipt and a package ID for the return from the delivery service, as it makes it easier to follow the return shipment if needed. studiojoachimmorineau.com will make a refund of eligible returns. If you paid by invoice, we will need a bank account number to transfer the money back to.


2.1 Shipping

To return your product, we require a receipt or proof of purchase. You should mail your product to: Studio Joachim-Morineau, EINDHOVEN, 5651 GW, Achtseweg Zuid 161E, Netherlands

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are shipping an item over 50 Euros, you should consider using a trackable shipping service or purchasing shipping insurance. We don't guarantee that we will receive your returned item.

 

2.2 Refund policy

Minor deviations will in no event be grounds for rejection, discount, dissolution of the agreement or damages. All details, models and pictures concerning colours, materials, dimensions and finishing will be for information purposes only.


Our policy lasts 14 days. If 14 days have gone by since your purchase, unfortunately we can't offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

 

2.2.1 Refunds

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.


2.2.2 Partial refunds

There are certain situations where only partial refunds are granted (if applicable): Any item not in its original condition, is damaged or missing parts for reasons not due to our error. Any item that is returned more than 14 days after delivery.


2.2.3 Late or missing refunds

If you haven't received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you've done all of this and you still have not received your refund yet, please contact us at: online-shop@studiojoachimmorineau.com.


2.2.4 Sale Items

Only regular priced items may be refunded, unfortunately sale items cannot be refunded.


2.2.5 Exchanges

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at online-shop@studiojoachimmorineau.com and send your item to: Studio Joachim-Morineau, EINDHOVEN, 5651 GW, Achtseweg Zuid 161E, Netherlands


2.2.6 Liability for loss

Studio Joachim-Morineau is not liable for any loss incurred by the Buyer as a result of defects, wrongful acts or otherwise, unless the damage is directly and exclusively due to gross negligence or intent on the part of Studio Joachim-Morineau. Only loss of which the Buyer has irrefutably proven that it is due to a circumstance or event for which Studio Joachim-Morineau can be held legally liable will qualify for compensation.

Loss related to damage to or loss of property or to personal injuries will qualify for compensation up to the amount invoiced for the delivery or partial delivery.


The Buyer indemnifies Studio Joachim-Morineau against any and all claims related to loss caused by third parties that are engaged in the performance of the agreement at the Buyer’s request and with the Buyer’s consent, and against any loss caused by materials supplied by third parties at the Buyer’s request and with the Buyer’s consent.


Studio Joachim-Morineau will not be liable for any loss caused by incompetent use of the products delivered or by their use for a purpose other than that for which they are suitable by objective standards.




3. Warranty


A 6 months warranty is applicable to defects in materials and workmanship. Studio Joachim-Morineau declares to have properly constructed the product, out of proper materials. If a defect might occur, after normal usage, handling and/or assembly of the item, the warranty is limited to a period of 6 months. After occurance the item(s) should be send back to Studio Joachim-Morineau for investigation to determine if warranty is applicable.


In no situation Studio Joachim-Morineau is responsible for consequential damages due to the (partial) failure of the product(s)

 



4. Changes to these terms & conditions


We reserve the right to modify our terms of service at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website.

 



5. Dutch law


These General Terms and Conditions are governed by Dutch law. In the event of disputes, the court of the place where the designer has its registered office will be the competent court.
